Finding parts isn't the issue. But they will not allow me to keep, or even buy the car back.... Such a waste. I'm beyond upset, and was treated like trash on the phone.

So....you don't have the option of saying f u. Shove the insurance claim and just fix the car yourself?


I can't imagine that they could force you into something can they?


I think at that point letting them know you will be in contact with a lawyer might put a fire under them.

I don't think I have a choice anymore, as the adjuster has came to see the car, and it has now been deemed a loss, and "unfit" for the road. The worst part is, I cannot find another one even close to what I had in this one.. Might be onto a new venture for now I guess.

Do you have receipts of the purchase cost and/or maintenance you've spent on it?

Sometimes this will help get you more....not sure for your case but might be helpful.

That car isn't even CLOSE to any legal standard of unfit for the road. Tell them they'll pay for the parts, and for half the cost of paint, or you'll take your chances with hiring a lawyer and suing them for a low appraisal of the car.


You need a hood, a fender, and a light. Track them down yourself, present them with the cost including shipping, and a quote for the paint from a trustworthy local body shop. I guarantee you can come in considerably under their estimate. If they refuse to consider it, then you really do have grounds for a lawsuit...

Not that it would be any better in privately-insured Ontario :P

As with any other jurisdiction, be ready to put up a fight... it'll take a lot of time, effort, and hassle, but you can win.

This, among other things has prompted a move back to BC. Am trying to delay this for a while so I can drive the car back to BC. Then I can deal with ICBC in person, plus i have bodyshop connections there as well.

So after some more emails and phone calls with ICBC, they will not whatsoever allow for a buy back on my car... I leave back to BC on the 26th, and will be driving my Jeep YJ around once I finally turn in the car... I bought my parts car from ICBC, and might try to get this one back that way, only time will tell i guess. There's no guarantee I'd win the bid either. If I see the car driving around town it'll kill me...

Didn't another member have a similar problem in the past with the Canadian gov't insurance? Something about how there has been too much fraud in the past with cars getting "totalled" (by having their friends at the body shop say the damage is way more than it is) and then people buying them back and selling them once they are fixed up.

From what I understand, It was more with ICBC adjusters/estimators making the value of repair enough to have it written off, and having people buy it thru auction ( licensed bidders/shops only. This is how I got my parts car) and then split sale profits once fixed, or otherwise.

Dude, you don't NEED a buy-back. The value of those repairs has been MASSIVELY inflated because they're using prices for new parts. Find the panels used and have them paint-matched, and I guarantee you can come in way lower than ICBC's estimate and force them to pay for the repair at a lower cost.

This I understand. The thing is, car has already been deemed a write off. I haven't signed anything, or accepted anything yet. I get back to BC on Saturday (driving Pontiac home) and then come Monday will deal with ICBC further.
