Um, I smell insurance fraud. These people are so stupid. If I did something like that, and knew it, I'd openly admit to it. It's way easier to come clean right away and take what comes than to try and hide it and have a lot worse consequences later. You can tell by the damage on their truck that it did the damage. :bs:

You don't have to get your car fixed at their shop. I have been in a few accidents(none my fault) in my 39 years of driving, and I get my car fixed at the shop of my choosing as long as the repair cost does not exceed the value of the car. Get yourself a lawyer and get this done, if not the insurance company will screw you over. It is up to them to PROVE that you are trying to defraud them. They will not file a police report claiming fraud, but if they do it's money in the bank for you. I also would NOT give them any pic's of your car from before the hit and run. It's up to them to prove your the bad guy and if they go that route it will cost them a lot of money($10,000+) for a $1200 to $1800 claim. I will bet you that the guy that is handling your claim gets a bonus for all moneys that he saves the company, that is why they want you to go to their shop.

I'm with these guys. The police report clearly states that the damage was from the truck hitting you. If they doubt that, have them talk to the citing officer.

As for the loaner car, if the only reason they aren't getting you one is because you may have another car, that's bs. The other items you may or may not own have absolutely no bearing on what they need to cover for you.

You can also choose the shop of your choice. IF you like the shop they recommend, then go for it. But if you have a shop you prefer, you have full rights to get it fixed there instead.

A little side thought... If for some reason they come back pushing on the fact they think you caused the damage, or aren't willing to pay up what is needed, you may want to consider getting your insurance company involved (assuming you have full coverage). If you have the ability to file a claim to them for the incident, they will most likely stand up to the other insurance company and neighbors on your behalf. My aunt was hit by someone who supposedly was a con bumper hit (made my aunt rear end her on purpose). She spoke with the officer and the person at her insurance company. The insurance company took care of everything form then on, and my aunt never heard from the insurance company of hte other party again (she was cleared quickly of any fault). Just making a point that you still may have options depending on how idiotic they act.

Thanks for all the advice guys.

All right....The insurance company told me to go the body shop on Tuesday at 9. I go in there on Tuesday morning and the lady behind the desk said that state farm was out there on Monday and that I was a day late. I have my neighbor with me that has had work done before and he knows the owner (plus he was my ride home). We ask for the owner and the owner comes out and tells me that state farm also told him Tuesday and showed up early. He had me leave the car there and I went to work. The owner of the shop called me on wednesday and he had it all straightened out. He had state farm come back out and they reviewed the pictures, and the agent told the guy at the body shop that there's supposed to be damage on the hood too from somebody jumping on it that they aren't gonna pay to fix that particular spot. There is no damage from jumping and he agreed with me on that. But he told me hes gonna fix the damage and that the insurance will cover it, so it will be like the car was never hit. He is going to have the parts monday and I should have the car back by next Tuesday or Wednesday, then back up for sale it goes.


A little side story about these people. Since the car was hit they have been causing problems with the other neighbors around here. They have a small parking lot behind their 3 unit apartment building thats only for the tenants. Across the street from them is an older lady and her niece, the niece has her car and a company vehicle, and her aunt has a car. She parks the company vehicle in front of the apartment building in the street and has been for years. The lady that hit my car left a nasty note on her window threatening her for parking there. She also accused the people that live next door of destroying some funiture when they aren't home. Well the people next door to them called the landlord and he says he wouldn't want to live by something like that, so we shouldn't have to either. He is going to try to have them evicted because it seems like they have a problem getting along with others.

The whole ins deal of totaling a car if the damage cost is more than the resale value really wreaks. If somebody hits me slightly I lose my car that I have $5000 into for a $1500 check.
Most insurance companies are 'reasonable'.
If you have receipts for repairs they will include in the compensation but it's items like aftermarket performance mods and A/V electronics that you won't get credit for.

They can do better... they can just raise the rates until said person can't afford it and *poof*..problem for the insurance company is solved.

I got the car back 2 days ago and it looks like it was never hit. Though the new paint kinda makes the bad spots where its chipping look worse. But i'm just glad its all fixed. Now back to trying to sell it.
