Today I was checking the front end of my 2002 sle after changing the oil. I noticed that the sway bar link bolts on both right and left sides did not have any top nuts. On the top was just a large washer that appeared to be turned onto the bolt threads sitting on top of a rubber spacer.

All the replacement links I have seen use a nut at the end of the bolt with the head of the bolt facing down toward the ground and the nut on the top. So I put on some washers and nuts and tightened to 156 inlbs (13ftlbs) as noted in my Chilton manual. The bolt threads looked like they had been without nuts for a long time.

Was the top washer that appears threaded the way the factory link was installed? Any info would be appreciated. The link did not show any signs of excessive movement.

Yes, it looks like a threaded washer, but is actually both a nut and retaining washer. There is no problem with replacing them with the aftermarket kit and using regular nuts and bolts that are included.
